"New Portsmouth City Ordinances"

Section 24-259. Prohibited Conduct in Public Places.

 

(a) It is unlawful for any person to engage in any of the following types of conduct:

     

  1. To obstruct, impede, or restrict the free passage of others along any portion of a sidewalk or public plaza, or into or from private property, after being asked or directed to move on by a sworn law enforcement officer.
  2. To lie or sit upon a mattress, or to lie or sleep, while on a public sidewalk or on the ground in a public plaza.
  3. While on a public sidewalk or public plaza, or while in a public parking area, to erect and/or to occupy a tent or other temporary protective structure after being asked or directed to move on by a sworn law enforcement officer. This paragraph shall not apply to any person acting with written City authorization or as part of a City-authorized festival or event.
  4. To fail to remove such tent or other protective structure described in the preceding paragraph, and also all debris or articles associated therewith, after being asked or directed to move on by a sworn law enforcement officer.
  5. To lie upon a bench that is on a sidewalk or in a public plaza.

 

(b) As used in this section, the term "public plaza" means only:

 

  1. he sidewalks, steps, and public areas surrounding or adjacent to High Street Landing and the North Landing.
  2. The public ways and parking areas along and adjacent to the seawall.

 

(c) This section shall not be interpreted or applied to lawful picketing, demonstrations, or the exercise of the right of free speech.

 

Sec. 24-260. Definition of loitering.

 

For purposes of sections 24-259 and 24-261, "loitering" shall mean remaining idle in essentially one place and shall include the concepts of spending time idly, loafing or walking about aimlessly.
